Governing Law
These terms and conditions are governed by and construed in accordance with the laws of the applicable jurisdiction and you irrevocably submit to the exclusive jurisdiction of the courts in that State or location.
Stock, Availability and Fulfillment
Availability is live, and nothing is allocated to you before payment. The availability shown next to an account is our best current figure and it changes continuously as other customers buy. Adding an item to your cart does not allocate it to you, and neither does starting the checkout. Because of this, an item can sell out between the moment a page is displayed and the moment your payment is taken.
Items shown as out of stock cannot be ordered. Where an account is unavailable it is clearly labeled as such at the point of sale and cannot be added to an order, whichever option you choose for it. Availability shown while we are still checking a figure is labeled as such, and an order cannot be placed against it either.
What happens if an item sells out mid-checkout: We check availability again at the moment payment is taken. If an item you have selected is no longer available at that moment, your order is stopped before any payment is captured, and you are told which item was affected so you can change your order and try again. In the rare case that a payment has already been taken and we are unable to supply an item, we will refund the amount paid for that item in accordance with our Refund Policy.
How we work to prevent it: Our availability figures update continuously on the page without a reload, and they come directly from our automated cloud inventory network rather than from a figure we maintain manually. We also re-check availability at the instant payment is taken, so an item that has run out stops the order before your money is taken rather than after.
